Section

1. General Terms

By submitting payment of any deposit or balance for an EXG Safaris trip, you (“Traveler,” “Client,” or “Participant”) acknowledge and agree to these Terms and Conditions.

EXG Safaris LLC (“Company,” “we,” “our,” or “EXG Safaris”) is a California limited liability company and operates in partnership with licensed ground operators in Africa.

These terms supersede all prior verbal or written communications.

2. Deposits and Confirmations

2.1 Offer Deposit

A $100 refundable deposit per traveler temporarily secures a booking or wait-list position for the specified safari offer.

Deposits are fully refundable only if the traveler cancels within 14 calendar days of payment or if EXG Safaris declines the requested dates.

After 14 days, deposits become non-refundable but fully transferable toward any EXG Safaris Safari departing within 24 months of original payment.

2.2 Final Payment

Final balance is due 120 days prior to departure unless otherwise stated in your confirmation.

Failure to remit payment by the due date may result in automatic cancellation and forfeiture of all deposits and fees paid.

2.3 Payment Methods

Payments may be made by credit card, ACH, or wire transfer.

All credit card transactions are subject to a 3% processing fee.

3. Cancellations by Traveler

3.1 Before Final Payment

If you cancel more than 120 days before departure:

Your $100 deposit is transferable only, not refundable after 14 days.

You may apply the credit toward any future EXG Safaris safari within 24 months.

3.2 After Final Payment

If cancellation occurs:

120-91 days prior: 25% of total trip cost is forfeited.

90-61 days prior: 50% of total trip cost is forfeited.

60-31 days prior: 75% of total trip cost is forfeited.

30 days or less: 100% of total trip cost is forfeited.

No refunds will be issued for unused portions of a safari or voluntary withdrawal during travel.

4. Cancellations or Modifications by EXG Safaris

EXG Safaris reserves the right to modify itineraries, dates, accommodations, or vehicles for safety, logistical, or regulatory reasons.

If EXG Safaris cancels a safari due to force majeure (e.g., natural disasters, political unrest, epidemics), all payments will be credited toward a rescheduled safari within 24 months or offer a trip to another destination.

EXG Safaris is not responsible for additional expenses (e.g., airfare, visas, vaccinations) incurred by travelers.

5. Refunds and Chargebacks

Refunds, if applicable, will be processed within 30 business days of written approval.

Chargebacks are strictly prohibited without prior written communication and resolution attempt.

Any unauthorized chargeback will incur a $250 administrative fee, and EXG Safaris reserves the right to pursue legal and collection remedies under California Civil Code §3300 et seq.

6. Travel Insurance Requirement

All travelers are required to carry comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, repatriation, baggage, and COVID-19 interruptions.

Failure to obtain adequate coverage releases EXG Safaris from any related liability or financial responsibility.

7. Responsibility & Liability Limitation

EXG Safaris acts solely as a booking agent for independent suppliers (lodges, airlines, ground transport).

EXG Safaris is not liable for injury, illness, loss, damage, delay, or expense caused by suppliers, acts of nature, war, strikes, civil unrest, or government actions.

Traveler assumes all inherent risks associated with travel in remote destinations.

In no event shall EXG Safaris’ liability exceed the amount paid by the traveler for services rendered.

California Civil Code §1668 disclaimer: Nothing herein releases EXG Safaris from gross negligence or willful misconduct, but EXG Safaris disclaims all other implied warranties to the maximum extent permitted by law.

8. Jurisdiction & Dispute Resolution

This agreement is governed by the laws of the State of California.

Any dispute shall be resolved exclusively by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association (AAA).

Each party shall bear its own legal fees and costs unless otherwise ordered by the arbitrator.

Traveler waives the right to participate in any class action or jury trial.

9. Force Majeure

EXG Safaris shall not be deemed in breach for any failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, pandemics, border closures, or governmental restrictions.

10. Media & Marketing Release

By participating in an EXG Safaris safari, you grant EXG Safaris permission to use photographs, videos, or testimonials for marketing purposes unless you provide written notice of objection prior to departure.

11. Severability

If any provision herein is deemed invalid, the remainder of the agreement shall continue in full force and effect.

12. Acknowledgment

By making a booking or paying any deposit, the traveler affirms that they:

Have read, understood, and agreed to this policy;

Are physically fit and medically cleared for travel;

Accept full responsibility for their decisions, insurance, and participation.
